1. Introduction

Welcome to Chatber ("we," "our," or "us"). Chatber is a WhatsApp Business SaaS platform operated by Evertics Infotech, based in Kerala, India. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform at chatber.com and associated services (collectively, the "Service").

By accessing or using Chatber, you agree to the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Service.

2. Information We Collect

2.1 Information You Provide to Us

We collect information that you voluntarily provide when you register for an account, subscribe to a plan, or use our Service:

  • Account Information: Your name, email address, password, business name, and contact details.
  • Payment Information: Billing details processed through Razorpay. We do not store your full credit card or debit card numbers on our servers.
  • WhatsApp Business Account Information: Phone Number ID, Business Account ID, access tokens, and webhook configuration details required to connect your WhatsApp Business API account.
  • Contact Data: Information about your WhatsApp contacts including names, phone numbers, country codes, tags, notes, subscription status, and custom attributes.
  • Message Data: The content of WhatsApp messages sent and received through your connected accounts, including text, interactive messages, media URLs, and message metadata.
  • Support Data: Information you provide when submitting support tickets, including descriptions and attachments.

2.2 Information Collected Automatically

When you use our Service, we may automatically collect:

  • Usage Data: Features accessed, actions performed, pages viewed, and time spent on the platform.
  • Device and Browser Information: IP address, browser type, operating system, and device identifiers.
  • Log Data: Server logs including access times, error logs, and API call records.
  • Cookies: We use cookies to maintain your session, remember preferences, and improve your experience.

3. How We Use Your Information

4. WhatsApp Data and Meta Compliance

Chatber integrates with the WhatsApp Business API provided by Meta Platforms, Inc. In connection with this integration:

  • We process WhatsApp messages and contact data solely for enabling you to communicate with your customers through the WhatsApp Business API.
  • We do not sell, rent, or share WhatsApp message content or contact data with third parties for their marketing purposes.
  • We comply with Meta's Business Messaging policies, WhatsApp Business API Terms of Service, and applicable data protection requirements.
  • Message content is stored on our servers to provide inbox functionality, analytics, and conversation history.
  • Your WhatsApp Business API access tokens are encrypted at rest and used solely for authenticating API requests to Meta.

5. Data Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

5.1 Service Providers

  • Razorpay: For payment processing and subscription management.
  • Meta (WhatsApp Business API): For delivering and receiving WhatsApp messages.
  • Cloud hosting providers: For data storage and server infrastructure.

5.2 Legal Requirements

We may disclose your information if required by law, regulation, legal process, or government request, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

5.3 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

6. Data Security

We implement appropriate technical and organizational security measures to protect your information:

  • Encryption of sensitive data such as passwords and API tokens at rest and in transit.
  • HTTPS/SSL encryption for all data transmitted between your browser and our servers.
  • Access controls and authentication mechanisms to restrict access to your data.
  • Regular security audits and monitoring for suspicious activity.
  • Cloudflare DDoS protection and web application firewall.

While we strive to protect your information, no method of transmission over the Internet is 100% secure. We cannot guarantee absolute security.

7. Data Retention

  • Account data is retained until you delete your account or request deletion.
  • Message data and conversation history are retained for the duration of your active subscription.
  • Payment records are retained as required by applicable tax and financial regulations.
  • Log data and analytics are retained for up to 12 months.

When you delete your account, we will delete or anonymize your personal information within 30 days, except where retention is required by law.

8. Your Rights

Depending on your location and applicable laws, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete personal information.
  • Deletion: Request deletion of your personal information, subject to legal retention requirements.

  • Withdrawal of Consent: Withdraw your consent at any time where processing is based on consent.

9. Contact Opt-Out and Unsubscribe

Your WhatsApp contacts can opt out of marketing messages at any time by sending "STOP" to your WhatsApp Business number. When a contact opts out:

  • Their status is automatically changed to "unsubscribed" in Chatber.
  • They will not receive broadcast or marketing messages.
  • They may still receive important transactional messages such as order confirmations.
  • They can opt back in by sending "START" to your WhatsApp Business number.

10. Cookies

  • Essential Cookies: Required for authentication and session management.
  • Preference Cookies: Remember your settings such as selected WhatsApp account and language.

We do not use third-party advertising cookies. You can configure your browser to refuse cookies, but some features may not function properly.

11. Children's Privacy

Chatber is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected such information, we will take steps to delete it promptly.

12. International Data Transfers

Chatber is operated from India. If you access the Service from outside India, your information may be transferred to, stored, and processed in India. By using the Service, you consent to this transfer and acknowledge that data protection laws in India may differ from those of your jurisdiction.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated policy.
